Land use right conversion under the Land Law 2024 and some recommendations

Abstract

According to current Vietnamese law, the conversion of land use rights only applies to agricultural land, is a right of land users, and is one of the methods for concentrating agricultural land. Based on an overview of documents and legal texts, this article analyzes the legal provisions regarding the conversion of land use rights, highlighting the new points concerning the conversion of agricultural land use rights in Land Law 2024 of Vietnam, including: (1) subjects and scope of land use right conversion; (2) objects of land use right conversion; (3) forms of land use right conversion; and (4) agricultural land concentration through the method of land use right conversion. Consequently, the article proposes several recommendations to enhance the capacity and responsibility of land management and supervision agencies, aiming to improve the effectiveness of land use right conversion and positively impact agricultural land concentration in the future.
