Legal provisions on working time and rest time and prosals for amendment and supplementation

Abstract

Right to work and rest is one of fundamental rights of workers in employment relations, which is regulated and protected by the law. After 6 years of implementing the 2012 Labour Code 2012 with certain successes, the legal provisions on working time and rest time have revealed many limitations, which need to be amended and supplemented. The paper assesses the current situation of the legal provisions on working time and rest time and their implementation. It also studies the practical and theoretical bases for improving the current legal provisions on working time and rest time. On that basis, the paper offers proposals to amend and supplement some provisions of the 2012 Labour Code in the context that the draft amended and supplemented 2012 Labour Code has been published for pressing consultation, which is planned to be submitted to the National Assembly in 2019.
