Obstacles in determining crime of organizing, brokering illegal entry, exit or stay in Vietnam and crime of organizing, brokering illegal emigration

Abstract

Recently, emigration and immigration crimes have become increasingly complex, posing significant risks to public order and security. However, in practice, it is difficult to determine charges for these types of crimes that affecting the investigation and prosecution. This article analyzes the obstacles in determing crimes of organizing, brokering illegal entry, exit or stay in Vietnam (Article 348 of the Penal Code) and crime of organizing, brokering illegal emigration (Article 349 of the Penal Code), thereby proposes some recommendations.
