SUPERVISION OF LEGAL COMPLIANCE IN VIETNAM'S CRIMINAL PROCEDURE - DRAWING INSIGHTS FOR IMPROVEMENT FROM THE RUSSIAN FEDERAL CRIMINAL PROCEDURE LAW

Abstract

Alongside the prosecutorial authority, ensuring legal compliance during various stages of criminal proceedings is another function of the Procuracy, playing a crucial role in ensuring strict and uniform adherence to criminal procedural laws. The research is aimed at analyzing this function, specifically concerning the subjects, content, and scope of supervising legal compliance in criminal proceedings in Vietnam, comparing it with the criminal procedural law of the Russian Federation. The study utilizes a synthetic method, analyzing and, notably, comparing legal provisions and scientific works on this function in the two countries to provide specific insights. The results of the research draw assessments regarding the similarities and differences between the two nations and propose measures to enhance this vital function for the criminal procedural law of Vietnam, aligning with the objectives set forth in Resolution No. 27-NQ/TW dated November 9, 2022, of the Sixth Plenum of the Central Committee of the Communist Party of Vietnam regarding the improvement of the institutional framework of the People's Procuracy.
