Hoàn thiện chế định người thân trong pháp luật Việt Nam

Abstract

In many Vietnamese legal documents, particularly those pertaining to civil, marriage, family, and criminal matters, the term “relatives” is used with various interpretations. The Civil Code, Criminal Procedure Code, the Law on Marriage and Family, the Law on Civil Judgment Execution, the Law on Enterprises, etc., and other legal documents are typical examples of the use of the term “relatives” with different connotations and scopes. Within the scope of this article, the authors provide a clearer analysis of the idea and layout guidelines for measuring the scope of adjustment for relatives. Besides, this article also analyzes some shortcomings in the practical application of Vietnamese law's rules regarding relatives and to make several recommendations.
