Tòa án trực tuyến thúc đẩy việc tiếp cận công lý
Abstract
The right to access the court is a basic human right, however, under the impact of the digital economy, with current legal regulations, it is very difficult for parties of e-commerce disputes and copyright infringement to access off the court. To cope with this challenge, some countries have established Internet courts to transfer the resolution of these disputes from the real courts to the Internet courts and use blockchain technology to secure evidences. This work is considered an important judicial innovation, helping to increase people's access to justice, however, it also raises many problems, such as whether or not the legal processes are guarantee, the public trials are fully implemented, the blockchain-based evidences are completely acceptable, etc. The article will answer these questions in turn and argue that the true justice must not only pursue absolute correctness but also create a balance between correctness and efficiency.
