Nguyên tắc xử lý hành chính đối với người chưa thành niên vi phạm pháp luật: Từ quy định pháp luật quốc tế đến nội luật hóa

Abstract

The paper analyzes international standards concerning the handling of violations by juveniles as specified in the following documents: “The United Nations Standard Minimum Rules for the Administration of Juvenile Justice” (1985); “The United Nations Rules for the Protection of Juveniles Deprived of their Liberty” (1991); and “The United Nations Guidelines for the Prevention of Juvenile Delinquency” (1990). The paper also analyzes the current status of the principles in administrative handling of juveniles (children) in conflict with law under Article 134 of the 2020 Law on Handling Administrative Violations to define the incorporation ofinternational standards in domestic law for the handlilng. The incorporation by the Vietnamese state is aimed at securing and safeguarding the rights and best interests for children - even regarding those in conflict with law, the handling is conducted with the aim to educate them to become good citizens, who contribute to society.
