Chứng cứ điện tử và lưu giữ chứng cứ điện tử bằng công nghệ Blockchain: Kinh nghiệm của Trung Quốc và hàm ý cho Việt Nam

Abstract

Blockchain technology has been impacting on resolving commercial dispute process in the court, including core issue such as evidence. Applying blockchain technology to dispute resolution activities is a common trend in the world, with China leading the way. However, applying blockchain in Vietnam has many barriers and challenges. Civil Procedure Code 2015 of Vietnam still leaves open the issue of electronically stored evidences to ensure its probative value while this type of evidences will be popular in the future. China's experience shows that blockchain technology is a reasonable solution for evidence storage. Therefore, this article focuses on analyzing China's experience in applying blockchain technology in storing electronic evidence and thereby proposing a number of suggestions for Vietnam to improve the law on resolving commercial disputes by the court.
