Hình thức pháp lý của doanh nghiệp xã hội ở một số Quốc gia: Kinh nghiệm cho Việt Nam

Abstract

On a global scale, researchers and legislators have many different approaches when building legal frameworks and organizational models for social enterprises operating. Among these approaches, there are two popular approaches in the world including: social enterprises operating under new legal forms and/or social enterprises operating under the legal forms of traditional business models (“open” legal form). Meanwhile, the social enterprises are still quite new in Vietnam, so it is very necessary to research foreign experiences to find organizational models suitable for the "hybrid" nature of social enterprises. The article uses comparative research method and analyzes typical legal forms of the social enterprises in a number of countries, thereby pointing out the advantages and disadvantages of these types as experience for Vietnam.
