Abstract

Abstract: A breakthrough of the United Nations Convention on the Law of the Sea
of 1982 (UNCLOS) was the establishment of a comprehensive system of compulsory
procedures for international dispute settlement in the law of the sea. This article
provides an overview of the Annex VII UNCLOS arbitral tribunal and its role in
resolving environmental disputes through case law. It sheds light on the jurisdictional
developments and fact-finding procedure innovations made by the South China Sea
Arbitral Tribunal in the field of the environment. The article concludes with reference to
and implications for Viet Nam.
