Abstract
Abstract: Unemployment insurance was first introduced in the 2006 Law on Social
Insurance, which took effect on 1st January 2009. Over the course of its implementation,
various shortcomings have emerged. Consequently, the Amended Draft Law on
Employment has been developed to address these issues. In this article, the authors
provide an overview of the unemployment insurance regime and examine Taiwan’s and
South Korea’s experiences with unemployment benefit levels, early reemployment
benefits, and benefit periods. These insights form the basis for commentary on the
corresponding provisions in the draft Law. By selectively learning from foreign legal
practices, the authors then make proposals to supplement and revise the Amended Draft
Law on Employment.
