Abstract

Abstract: A significant change in the 2024 Land Law is the removal of households
from the list of recognized land users in Vietnam. Despite the novelty, it is a necessary
provision that received considerable support during the drafting process, the continued
recognition of land use rights for this group is deeply rooted in historical practice. The
2024 Land Law effectively addresses this transition, providing flexibility for affected
individuals to continue exercising their rights. However, certain shortcomings remain,
particularly concerning the determination of household members—an issue that is not
fully clarified in the 2024 Land Law. In addition to analyzing these remaining
challenges, this article makes proposals to improve the relevant legal framework.
