Abstract

Abstract: When a person requesting notarization is illiterate, the law mandates the
presence of witnesses to ensure that the contract or transaction is concluded in an
equitable and transparent manner, and to protect the person’s legitimate interests.
However, the legal provisions concerning witnesses are limited and insufficiently
detailed, resulting in significant challenges and complications in notarial practice.
This article analyzes the deficiencies and shortcomings in the legal framework
governing witnesses in notarization activities and highlights the professional risks that
notaries may face as a result. Accordingly, it puts forward proposals and solutions to
address such risks.
