Abstract

Abstract: The State may allocate land to investors for the construction of projects
that serve the public interest. In practice, however, some developers do not implement
their projects in accordance with the schedule initially committed. Under the 2024 Land
Law, the State may either extend the developer’s land-use term or directly recover the
land without compensating for the land itself or the assets attached to it. Although these
provisions have been specified more clearly, difficulties persist in application. This
article identifies shortcomings in determining when an extension may be granted,
clarifies the scope of force majeure affecting project timelines, and proposes solutions to
improve the law governing land recovery in general and, in particular, recovery in
respect of delayed projects.
