Abstract

Abstract: On 24 November 2015, Vietnam became a party to the 1980 Vienna
Convention on Contracts for the International Sale of Goods (CISG), thereby
reinforcing Vietnam’s role in the harmonisation of private international law. Focusing
on Article 72 CISG—governing the right to terminate a contract in the event of
anticipatory breach—and drawing on decisions by courts and arbitral tribunals
worldwide, this article identifies shortcomings in current Vietnamese law and advances
recommendations for its improvement.
