Abstract

Abstract: The article focuses on analysing the mechanism for settling disputes
between investors and states (ISDS), the challenges in its implementation and ongoing
reform proposals aimed at enhancing the transparency, fairness and effectiveness of this
mechanism. On the basis of that analysis, the article puts forward a number of solutions
to reduce Vietnam's exposure to risks arising from the ISDS mechanism, such as actively
participating in international discussions, promoting ISDS reform at the global level,
prioritising the upgrading of existing investment agreements, improving the domestic
legal framework and strengthening the enforcement capacity of relevant officials.
