Abstract

Abstract: The procedure for recognizing and enforcing foreign arbitral awards in
Vietnam is generally well-established. However, several provisions remain ambiguous
or impractical. These include the criteria for identifying a foreign arbitral award, the
statute of limitations for submitting recognition and enforcement requests, and whether
awards relating to disputes falling within the exclusive jurisdiction of Vietnamese courts
can be enforced. This article identifies shortcomings and provides reform proposals.
