Abstract
Abstract: This article examines the doctrine of rebus sic stantibus (fundamental
change of circumstances) in international law and its relationship with principles of
international investment protection, with particular attention to its implications for
Vietnam. The article analyses the content and conditions for its application under
Article 62 of the 1969 Vienna Convention on the Law of Treaties, as well as its
interaction with investment protection standards such as fair and equitable treatment,
full protection and security, non-discrimination and protection against indirect
expropriation. Drawing on practice in the settlement of international investment
disputes, the article advances recommendations for Vietnam on how to apply the
doctrine of rebus sic stantibus effectively in managing international investment disputes.
