Abstract

Abstract: Based on a practical study of the application of Clause 5, Article 101 and
Clause 2, Article 102 of the Law on Civil Judgement Enforcement 2008 (amended and
supplemented in 2014), the article forecasts potential inadequacies and impediments
arising from Clause 3, Article 125 and Clause 2, Article 128 of the Draft amended Law
on Civil Judgement Enforcement. From this basis, the article proposes solutions for
improvement aimed at resolving shortcomings, removing impediments, better protecting
the legitimate rights and interests of subjects, and at the same time ensuring consistency
between the law on civil judgement enforcement and the law on property auction.
