DEFINING PARENTS-CHILD AND PERSONAL RIGHTS IN THE CASE OF CHILDBIRTH BY ASSITED REPRODUCTION ACCORDING TO VIETNAMESE LAW

Abstract

Personal rights are one of the most fundamental rights of a natural person and thus definitely received legal protection. According to the Civil Code of 2015, the personal rights in marriage and family relations are stipulated as: “Each individual has the right to marry or divorce, the right to equality between husband and wife, the right to acknowledge father, mother or child, the right to adopt children and be adopted in marriage relation, parent-children relation and relations between family’s members”. Among these, the personal relation between parent-children is one of the deeply concerned issues. In this article, the author will focus on identifying father for children in the case of childbirth by assisted reproductive techniques.
