Abstract

The article focuses on analyzing the relationship between the United Nations Convention on the Law of the Sea 1982 (UNCLOS) and Vietnam's new-generation Free Trade Agreements (FTA). It examines the provisions of UNCLOS on marine environmental protection and the strong commitments in new-generation các FTA that combine trade objectives with environmental protection. Based on this analysis, the article evaluates the compatibility and conflicts between các FTA and UNCLOS. It highlights the need to balance economic development in marine sectors with environmental protection through the integration of UNCLOS and FTA provisions, offering solutions to balance trade benefits and marine environmental protection. The author emphasizes the importance of maintaining a balance and harmony between economic development and marine environmental protection through coordination between UNCLOS and FTA regulations. This balance and harmony play a critical role in promoting sustainable marine economic development and protecting Vietnam's marine environment.
