SOME ISSUES ABOUT TRANSFER OF LAND USE RIGHTS IN VIET NAM

Abstract

The article focuses on analyzing some problems related to the land use right transfer transaction: regarding the party being a foreign-invested enterprise; the limits, conditions, transfer time of land use right and some other legal issues. In addition, to ensure the consistency of the law, the article compares with relevant legal provisions such as the Investment Law 2020, Housing Law 2014, and Law on Real Estate Business 2014 to propose recommendations for the regulation amendmeng on transfer of land use rights in accordance with the requirements of the economy.
