Legislated provision on human rights, basic civil rights and duties under the Constitution of the Socialist Republic of Vietnam

Abstract

The Constitution is a basic code and has the utmost legal validity in the legal system in Vietnam. The Constitution of the Socialist Republic of Vietnam, approved by the National Assembly XIII in 2013 and validating from January 1st 2014, has marked a major turning point in the constitutional history of Vietnam. There have been many fundamental issues adjusted by the Constitution, in which the human rights, the basic civil rights and duties have been approved and the basic principles for implementing them have also been identified and defined. To ensure consistency in the legal system as well as the socialist legislation, the work of legislatively concretizing the above rights is considered an essential issue and should require much consideration and research.
