Recommendations for the Improvement of Current Legal Regulations on Construction Contracts
Abstract
The Law on Construction 2014 and the Law amending and supplementing a number of articles of the
Law on Construction 2020 regulate construction investment activities using different sources of capital. The
current Government Decrees on construction contracts only govern contracts funded by state capital, while
the Law on Construction and its implementing Decrees apply to all sources of capital. Moreover, the Decree
on construction contracts, which has been in effect for the past 10 years, has not undergone comprehensive,
timely, and consistent revisions in line with other Decrees and with the practical needs of development. The
provisions of the law on bidding regarding the use of state capital are also not consistent and unified with
construction law concerning the content and general conditions of construction contracts. It is therefore
urgent to fundamentally amend the provisions of the Decree on construction contracts to promptly meet the
practical development needs of the construction sector. In particular, attention must be paid to the scope
of regulation, consistency with other provisions of construction law, applicability to all sources of capital,
alignment with changes in practice, and other issues related to construction contracts.
