Civil law specialization in the process of legal reform in the Draft law on civil legal assistance
Abstract
In the context of increasingly profound international integration among nations, issues relating to legal assistance in civil matters in Vietnam have become more prevalent, thereby revealing various limitations in practical implementation. To ensure coherence, uniformity, and feasibility in the application of law, the Draft Law on Civil Legal Assistance has been developed in the direction of specialization, separating civil legal assistance from criminal matters, extradition, and transfer of persons who are serving imprisonment sentences under the Law on Legal Assistance 2007. The separation of specific areas within legal assistance not only contributes to the development of a more comprehensive legal framework but also reflects Vietnam’s commitment to international integration by distinguishing between “public” and “private” legal assistance, in accordance with international practice. This Article analyzes the key new provisions introduced during the specialization process of civil legal assistance under the Draft Law on Civil Legal Assistance 2025.
