Abstract

Delegation of legislative power is an inevitable phenomenon in the modern state and legal system, enabling the Government and executive bodies to specify legal documents to ensure their practical enforceability. However, the expansion of regulatory authority to the executive branch raises the need for enhanced oversight over the issuance of delegated legislation. In this article, the authors assess changes in the law regarding delegated legislation and demonstrate the necessity to increase legislative oversight of this activity. The authors propose three recommendations to perfect the power control mechanism in the promulgation of delegated legislation within the Draft Law on Supervisory Activities of the National Assembly and People’s Councils (Amended): i) Ensuring the democratic principle in supervisory activities; ii) Controlling conflicts of interest in the supervision process; iii) Expanding the scope of supervision to include the rationality of sub-law documents, ensuring such documents are not only comply with procedural requirements but also conform to constitutional and legal principles.
