Abstract
The establishment of an International Financial Center in Vietnam is a strategic move aimed at deep integration into the global financial market and attracting foreign investment. In this context, building an effective, transparent dispute resolution mechanism compliant with international standards is a crucial factor. This article analyzes notable provisions in the draft Law on the Specialized Court at the International Financial Center and the draft Decree on on the International Arbitration Center under the Vietnam International Financial Center and the application of law, and dispute resolution at the International Financial Center, including the expansion of jurisdiction, flexibility regarding the governing law and language, and reforms concerning the judiciary and arbitrators. Although these drafts demonstrate Vietnam’s significant efforts in modernizing its legal framework, potential limitations and challenges remain regarding the flexibility of arbitration procedures, infrastructure, human resources, legal risks, language synchronization, and enforcement mechanisms for judgments and awards. Based on this, the author proposes specific recommendations to perfect the drafts, ensuring the competitiveness and international integration of the Vietnam International Financial Center.
