Judicial enstrustment from Vietnam to foreign countries in the draft law on civil judicial assistance

Abstract

In the context of international integration, judicial entrustment is regarded as an effective mechanism for resolving civil cases involving foreign elements. This necessitates that each country establishes a comprehensive, coherent, and efficient legal framework. To meet these demands, regulations on judicial assistance are being reviewed and refined through the proposed enactment of the Law on Civil legal assistance. Within the scope of this article, the authors focus on analyzing and assessing some revisions concerning judicial entrustment from Vietnam to foreign jurisdictions in the draft Law on Civil Legal Assistance, as well as examining relevant regulations in other countries to draw experiences for Vietnam.
