Recommendations on the provisions of the Draft Law on Mutual Legal Assistance in criminal matters to meet the requirements of combating transnational crime

Abstract
Mutual legal assistance (MLA) in criminal matters is an essential mechanism of international cooperation, enabling states to assist one another in the investigation, prosecution, and adjudication of crimes such as human trafficking, money laundering, drug trafficking, terrorism, and cybercrime. This article analyzes the theoretical and legal foundations as well as the role of MLA in combating transnational crimes while simultaneously assessing the current state of Vietnam’s legal framework on mutual legal assistance in criminal matters. Then, it provides recommendations for improving the Draft Law on Mutual Legal Assistance in Criminal Matters.
