CONFIDENTIALITY AGREEMENT IN THE EMPLOYMENT CONTRACT

Abstract

Currently, with the developing market economy and the increasing number of workers, confidentiality clauses are no longer a new issue in our country, as many businesses use this clause to protect their intellectual property from numerous competitors in the market. However, the confidentiality clause has also sparked controversy as it brings considerable disadvantages to employees even after the employment contract (EC) has ended. In this article, the author will analyze and evaluate the current legal regulations and the practical application of the confidentiality clause in employment contracts, and from there, propose solutions to improve Vietnamese law regarding the confidentiality clause in employment contracts.
