Issues about conditions verification civil judgment and solutions to complete law

Abstract

Civil judgment enforcement is a specific task that is complicated, difficult and even dangerous because it affects the interests, economic, spiritual and daily life of the judgment debtor. Therefore, in the course of civil judgment enforcement, enforcers must perform many orders and procedures and go through many stages of judgment execution seriously, properly and fully in accordance with the law. Besides, verifying judgment execution conditions is one of the procedures with the most important role. Verification results are the basis for enforcers to persuade involved parties to execute judgments, and are the basis for heads of judgment enforcement agencies to issue decisions on entrustment, judgment enforcement suspension or for enforcers to choose appropriate coercive enforcement. Currently, legal documents regulating the verification of civil judgment execution conditions, although regularly updated and adjusted, still have legal loopholes. Within the scope of this article, this study will analyze the problems and limitations and offer solutions to overcome the shortcomings of the current civil judgment enforcement verification.
