Freedom of speech, and cyber violence: legal and practical analysis in Vietnam
Abstract
Freedom of speech is one of the fundamental human rights; however, in the rapidly evolving digital space, this right is increasingly challenged by the rise of cyber violence. This study aims to assess the relationship between freedom of speech and cyber violence, thereby proposing solutions to balance the protection of human rights and the regulation of harmful behaviors in cyberspace. To conduct this research, the author employs the method of document analysis and synthesis to evaluate the impact of cyber violence on freedom of speech. The research findings indicate that, while freedom of speech is legally protected, the misuse of this right to attack or defame individuals online poses significant legal and social challenges. At the same time, content control measures on the Internet also risk infringing on freedom of speech if not implemented appropriately. Based on these findings, the study proposes recommendations to improve the legal framework, enhance measures to protect victims of cyber violence, and ensure that freedom of speech is not arbitrarily restricted.
