Ensuring investors’ rights to business and investment under vietnamese investment law

Abstract

The article focuses on clarifying the provisions on investment protection for investors under the current Vietnamese investment law by dícussing three main issues: 1) The legal framework guaranteeing investors’ rights to business, investment; 2) The content of the provisions guaranteeing investors’ rights to business, investment; 3) Some comments and recommendations for improvement. The research results show that the provisions on investor protection policies are being improved so as to better exploit the advantages and resources brought by investment as well as to better ensure the rights and interests of investors. However, the law on investment still has some limitations and shortcomings that need to be addressed to better attract, protect, develop business investment relations in accordance with international practices, and to optimise competitive advantages through rationalising legal provisions towards sustainable benefits between the state and investors.
