Terminating an individual's legal presence by declaring their death – a comparison with the Chinese Civil code

Abstract
Although Vietnamese law does stipulate the conditions for declaring someone’s death and its legal consequences, not all of real-life situations are covered. By comparing Vietnamese and Chinese civil codes, the article analyses the conditions for declaring someone’s death, its legal consequences, and the legal consequences of revoking a death declaration, thereby suggesting legal solutions to improve Vietnamese law on this institution.
