Some limitations in the legislative draughting techniques used in the 2015 Civil Code

Abstract

This article presents several findings on the limitations in the legislative draughting techniques used in the 2015 Civil Code. They are divided into three main groups: 1) Limitations in the formulation of titles and the structure of sections, chapters, and articles (four limitations); 2) Limitations in the use of terminologies, including inaccurate, inconsistent, and inappropriate terminologies (10 limitations); 3) Limitations in expression, including inaccuracies, inconsistencies, lack of clarity, and poor coherence (18 limitations). In addition to analysing each of these limitations, the article makes specific recommendations to overcome them. This article serves as a valuable reference for lawmakers in draughting legal documents within the field of civil law.
