Administrative lawsuit claims under Vietnamese administrative procedural law
Abstract
Administrative lawsuit claims include specific issues that agencies, organisations, and individuals request courts to resolve when exercising their right to initiate administrative cases. Fully and accurately identifying administrative lawsuit claims is of significant importance to both plaintiffs and courts. In recent times, legal provisions and the practical implementation of laws regarding administrative lawsuit claims have encountered certain limitations that affect the legal rights and interests of plaintiffs and the effectiveness of administrative case resolution in Vietnam. This article aims to clarify the concept and characteristics of administrative lawsuit claims, analyse legal provisions and their practical implementation concerning administrative lawsuit claims, thereby proposing some recommendations to improve Vietnam’s administrative procedural law regarding administrative lawsuit claims.
