Legislation on intellectual property in cross-border commercial transactions in the context of digital transformation

Abstract

In the context of global digital transformation, the protection of intellectual property rights (IPR) in cross-border commercial transactions has become increasingly urgent. Vietnam has implemented policies related to digital transformation and intellectual property to adapt to the Fourth Industrial Revolution. However, challenges and limitations remain in the enforcement and protection of IPR. Although technologies such as blockchain, smart contracts, and artificial intelligence can effectively support IPR protection, legal and technological gaps must still be addressed to enhance the efficiency of IPR protection in the digital age. This article aims to clarify the role and impact of IPR provisions on international trade transactions in the context of global digitalisation and to analyse existing issues in IPR protection in Vietnam. Based on this analysis, the article proposes some solutions to improve the protection of IPR in cross-border trade transactions in the context of digital transformation.
