The current state of Vietnamese law pertaining to cemetery real estate businesses - Recommendations for improvement

Abstract

Recently, the real estate market has become increasingly diverse, with many new types of properties being introduced. Among them, cemetery real estate is considered a potential sector with high economic value and alignment with Vietnamese cultural traditions. However, the current legal provisions on cemetery real estate businesses still have many shortcomings and are not fully compatible with existing provisions. This article examines the legal requirements for cemetery real estate businesses (land use rights for cemeteries with infrastructure) under the 2024 Law on Land, the 2023 Law on Real Estate Trading, and other pertinent laws. Through analysing the existing inconsistencies and incompatibilities in the laws, this article makes some suggestions to enhance Vietnam's legal framework on the cemetery real estate industry.
