BREACH OF THE PROVISIONS ON AUTHORISATION IN CIVIL PROCEDURE - DIFFICULTIES AND PROPOSALS FOR LAW IMPROVEMENT

Abstract

Analysing some cases at court on contract disputes over the request to perform obligations and to claim damages for breaching contracts, the paper points out some difficulties in:  amending and supplementing the petition to initiate the case;  request to initiate the case;  request for counter-claim; and representation by law and representaion by authorisation in civil procedure. It also offers some proposals for law improvement in the light of prioritising the protection of rights and interests of parties when there is the breach of civil steps and procedures.
