Jurisdiction of Vietnam’s courts to settle civil cases involving foreign elements

Abstract

The paper analyses the new provisions of the 2015 Civil Procedure Code on the ways to define the common jurisdiction and the exclusive jurisdiction of Vietnam’s courts. The paper argues that it is an advance of the current Vietnamese legal system to recognise the extraterritorial jurisdiction of Vietnam’s courts and to establish the exclusive jurisdiction of Vietnam’s courts based on agreement of the parties in some cases.
