CRIMINAL LIABILITY OF LEGAL ENTITIES UNDER INTERNATIONAL LAW

Abstract

Before the 2015 Criminal Code (amended and supplemented in 2017) was passed the issue of criminal liability of legal entities attracted many studies in different perspectives and at different levels. These studies commonly recognise the need to prescribe criminal liability of commercial legal enitities in criminal law. There are, however, almost none of studies on criminal liability of legal entities under international law. The paper analyses and assesses some universal treaties relating to liabilities of legal entities in general and criminal liability of legal entities in particular. On that basis, it offers scientific conclusions and asserts that with their sovereignty and the law, the countries have full powers to determine legal liabilities of legal entities as criminal liability, civil liability or administrative liability.
