The determination of husband and wife’s joint property, private property and property obligations in case husband or wife is an enterprise’s owner

Abstract

The article refers to the legal basis for determining joint property, private property, including the marriage period and the origin of the property; legal basis for determining property obligations of husband and wife, including the purpose of the transaction, the will of husband and wife and illegal acts based on the Law on Marriage and Family 2014. From that, the article will analise specific cases in each type of enterprises to determine joint property, private property and property obligations of husband and wife when husband or wife runs  private enterprise’s owner, a partnership member, a limited liability company’s member, or a joint stock company’s member. In particular, the article gives views on identifying joint property, private property of husband and wife when husband or wife is an enterprise’s owner to ensure the legitimate rights and interests of husband and wife and the stability of society in the current socio-economic conditions.
