The procedural law of Vietnam from the XVth century to the XIXth century - The historical and contemporary values
Abstract
Building atransparent, strong, democratic, strict judicial system which ensures protecting justice, gradually modernizing, serving the people andthe Fatherland, contributing to the maintainance of political security and social order, promoting socio-economic development and international integration is one of the important contents of the Judicial Reform Strategy in particular and towards the orientation of building a socialist rule of law state in general in Vietnam today. The article analyzes the characteristics, content and highlights the values of legal proceedings in Vietnam during the feudalism, focusing on the period from the 15th to the 19th century. It is a proceeding aimed at protecting the legitimate rights of people; upholding the purity, transparency and publicity in judicial activities; taking many measures to strengthen the supervision over the adjudication work; selecting qualified and virtuous mandarins to ensure objectivity and fairness in judgments and at the same time focusing on improving the efficiency of judgment enforcement. Researching the content and value of the feudal procedural law suggests many lessons for the implementation of the Judicial Reform Strategy in our country today.
