Abstract

Crime refers to an act which is dangerous to the society as prescribed in the Penal Code, reflecting the legal nature of such act compared to other acts. However, there are only a few of research works on the definition of crimes and how to identify similar crimes, more severe crimes, and less severe crimes. Therefore, this paper aims at clarifying the definition of crimes, identifying criteria of similar crimes, more severe crimes, and less severe crimes as illustrated in provisions of the Penal Code 2015 to make recommendations on the definitions of these types of crimes, with the aims of ensuring proper determination of crimes and “levels” of penal liability, applying accurate penalties, and improving the effectiveness of crime prevention.
