Improving legal provisions on social supervision of people's council at all levels in Vietnam
Abstract
The organizational model of the Vietnamese state is divided into four systems of agencies, in which the People's Council is the branch of the representative agency which is also known as the system of state power agencies. At the local level, People's Councils at all levels have the function to decide on important local issues that are assigned in legal documents of superior state agencies and supervise the observance of the law of other local state agencies. This is the only local authority directly elected by the people, receiving power directly from the people and representing the will of the people in deciding important local issues. However, the supervision and restraint mechanism from other state agencies (such as the executive and judiciary) for People's Councils at all levels is not really clear and effective. Therefore, in order to avoid the abusement or failure to fulfill the representative function of local authorities, it is extremely important and necessary to build and improve the social supervision mechanism for People's Councils at all levels.
