Changes, supplements and withdrawal of appeals under provisions of the administrative procedures law 2015 (amended and supplemented in 2019)

Abstract

The Law on Administrative Procedures 2015 (amended and supplemented in 2019) stipulates changes, supplements and withdrawal of appeals in Article 218 and a number of other relevant provisions. However, these provisions are still insufficient and inadequate, making it difficult to understand and uniformly apply the law. From the analysis of provisions on changing, supplementing and withdrawing appeals of appellants, the article focuses on explaining and clearly demonstrating limitations such as: The Law on Administrative Procedures does not clearly define which changes and supplements of appeal that does not exceed the scope of the initial appeal, the provisions on the authority to suspend the appellate trial when the appellant withdraws the appeal are still overlapped, etc., and proposes solutions and recommendations to improve the above limitations.
