Partial award and interim award: Perception of Swiss law and proposal for Vietnam
Abstract
In addition to two common types of arbitral awards including final award and consent award, Swiss law especially takes into account the other types of awards, which are partial award and interim award. While the partial award concentrates on the quantity and resolves a partial substance of the merit, the interim award focuses on the quality and resolves the matters relating to arbitral procedure. Different from Swiss law, Vietnamese law only governs the final award and the consent award. The partial award and the interim award do not exist in Vietnamese law. The article firstly presents the legal aspect of the partial award and the interim award under the perception of Swiss law, then analyzes provisions of Vietnamese current laws to point out some drawbacks and to propose some legal and technical suggestions in order to improve the Vietnamese law.
