Some issues need to be determined regarding joint testament

Abstract

Different from the previous civil codes, there is no provision of the Civil Code 2015 of Vietnam on joint testament. However, in fact, joint testaments are still made, hence there are difficulties in determining the testators of a joint testament, such testament is made by husband and wife (spouses in a marriage relationship) or by couples who are not in a marriage relationship also. The article gives a personal opinion on whether to recognize a joint testament or not. If acknowledged, the questions of the effective time and how to amend, supplement, replace or cancel the joint testament still need to be determined.
