Parliamentary non - accountability in the Republic of France and reference experience for Vietnam
Abstract
The parliamentary non - accountability plays an important role in the activities of members of Parliament (MPs), contributing to ensuring the freedom and independence of mind of MPs when performing their duties. However, this right has not yet been recognized by Vietnamese law. The article analyzes some issues of parliamentary non - accountability in the Republic of France. On that basis, the article gives some reference experiences for Vietnam when legalizing parliamentary non - accountability, such as: the object entitled to the right (should only be a member of the National Assembly), the starting and ending time of the right (should be counted from the time the National Assembly deputies start performing their duties until the termination of the National Assembly deputies’ status), the act of enjoying the rights and the degree of protection of such rights (the National Assembly deputies are not responsible to anyone, except the National Assembly and voters, for acts related to the exercise of responsibilities and powers of the National Assembly deputies), the authority to repeal this right (only belongs to the National Assembly).
