A number of issues on the development of forensic expertise in China
Abstract
Forensic expertise is the use of scientific, technical and professional knowledge and methods to render a conclusion on relevant issues relating to criminal, administrative or civil cases. Forensic expertise is one of the most widely used methods of judicial proof worldwide, including China. The construction and improvement of judicial expertise system plays an extremely important role in promoting judicial justice, resolving conflicts and disputes, safeguarding the legitimate rights and interests of citizens and social harmony and stability. This paper focuses on the development of Forensic Science in China since the promulgation of “The decision on the management of forensic expertise” in 2005, and the existing problems, such as the disunity of judicial expertise system, the non neutrality of institutions, the imbalance of resource allocation, the excessive marketization, the imperfection of laws and regulations, and the lack of scientific and technological research, etc., and puts forward reform suggestions to adapt to the judicial expertise identification management needs to be incorporated into the construction of public legal service system.
